No land, so the work is done by hand
There is almost nothing here that looks like a suburban tunnel site, because there is almost no parcel that could hold one. A conveyor plus a stack lot plus a vacuum court needs frontage and depth that this market prices out of reach, so capital goes into hand wash and detail operations that turn a narrow lot between two older buildings into revenue by adding labour. Detail shops make up 56.7% of Hudson County’s tracked locations.
That inverts the coverage stack. Equipment breakdown drops down the list because there is less machinery to break. Workers compensation and employment practices climb, because headcount is the business. And garage keepers changes character: the vehicle is in your care for hours rather than four minutes, sometimes overnight, which is extended care, custody and control, with the keys, the cabin and the paint all in your people's hands.
Urban-core payroll, and what it does to an audit
Union County car wash payroll averages $42,105 a year and Hudson $39,719, and that number does more work than operators expect. It sets the workers compensation base, it sets what an auditor can recover if the class split was wrong, and it sets what an unpaid-overtime claim is worth when the timesheets are thin. In this state a wage claim reaches back six years, not two, and the lookback does not scale with what you pay.
Your class code here is CRIB 8396 — automobile car wash, published by the Compensation Rating and Inspection Bureau, not the NCCI code the national sites quote. Payroll allocation between the wash crew, the detail crew and office staff is worth checking against your last audit worksheet before the next one lands, and it is worth checking in the language your crew actually works in — the New Jersey Department of Labor requires six years of records kept at the place of employment or a central New Jersey office.
Is your workers compensation payroll split the way you actually run the crew? Send the last audit worksheet with the declarations page.
Four authorities, one county line apart
The permitting answer depends entirely on where the water goes, and here it changes on the far side of a bridge. If your lateral runs to a sanitary sewer you are an indirect user, and the authority at the end of that pipe does your permitting instead of the state, provided it operates an NJDEP-approved pretreatment programme. The Passaic Valley Sewerage Commission rules, effective 1 July 2023, are the ones we can quote precisely: §301.1 bars any user discharging without a PVSC permit, and §312.1(d) caps industrial wastes at 150 mg/l petroleum-based oil or grease in a single sample and a 100 mg/l monthly average. That limit is exactly what an undersized or unmaintained oil-water separator fails.
Every other authority in New Jersey has its own numbers, and three more of them operate inside these three counties. Never assume PVSC's limits apply to your district — name your authority and read its rules. Discharge to ground water is rare on this ground but not impossible, and it means a NJPDES permit under N.J.A.C. 7:14A-7, whose application runs to mapping, borings, records for every well inside a half-mile and a conductivity test. Septic is prohibited outright under N.J.A.C. 7:9A-1.6.
The Turnpike belt behind the retail
Routes 1&9 and the Turnpike between exits 13 and 15E carry the other half of this market. Commuter throughput is what makes the retail wash work, but the same geography carries port drayage, last-mile logistics and municipal fleets, and a wash with a wide enough bay picks up fleet work under contract.
That brings two things a retail-only wash does not have. Your people get behind the wheel of somebody else's vehicle, which is commercial auto liability rather than garage keepers. And the contract itself is an exposure, because garage keepers excludes contractual liability unless the liability would exist without the contract — so an indemnity clause signed to win a fleet account may be sitting outside the endorsement that everyone assumes covers it.
Essex, Hudson and Union car wash insurance questions
Does my car wash need garage keepers insurance if customers stay in the car?
Yes, though on this ground the question usually arrives inverted. Very little of the work here is a four-minute conveyor pass; it is hand-applied, and the vehicle sits with you for hours. That is extended care, custody and control — a longer and larger exposure than a drive-through endorsement is normally priced against. General liability will not reach it whichever way the argument goes, because it excludes property in your care.
What's the difference between garage keepers legal liability and direct primary?
One of them asks whether you were at fault and one of them does not. Under legal liability you pay what a court could make you pay, which on a detail account means a paint or trim claim nobody can prove was careless is a denial. Direct primary pays without that finding and pays ahead of every other policy in the picture. Direct excess is the middle setting: it pays without fault, but only after the customer’s own insurer has gone first.
Do I need a NJDEP permit to run a car wash in New Jersey?
It depends entirely on where the water goes. Discharge to a sanitary sewer makes you an indirect user of your local authority, and where that authority runs an NJDEP-approved pretreatment programme it permits you rather than the state. Discharge to ground water means a NJPDES permit under N.J.A.C. 7:14A-7. Septic is prohibited outright. Between Newark, Jersey City and the Union County authorities you may be four different districts away from your competitor.
What workers comp class code should a New Jersey car wash be on?
New Jersey does not use NCCI. Classifications come from the Compensation Rating and Inspection Bureau, and the class is 8396 — automobile car wash. National sites quote NCCI 8380; that code is real and it is not yours. At these wage levels, a misclassification costs more at audit than the same error on a smaller payroll.
